Darklight Audio respects the intellectual property rights of others and expects Tracklyst users to do the same. This page explains how to report claimed copyright infringement and how we respond.
What Tracklyst does and doesn't host
Tracklyst is a sharing and feedback layer for audio stored in a user's own Dropbox or Microsoft OneDrive account — we don't host audio files on our own servers. Some features let a track owner sell paid access to a track or download through Stripe. If you believe content shared or sold through Tracklyst infringes your copyright, we want to know and will act on valid notices.
Filing a notice
If you believe your copyrighted work has been shared or sold through Tracklyst without authorization, send a written notice to our designated agent (below) that includes:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material you claim is infringing, and information reasonably sufficient to let us locate it (e.g. the share link URL).
- Your contact information — address, phone number, and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.
Counter-notice
If you believe content you shared was removed or disabled by mistake or misidentification, you may submit a counter-notice to our designated agent that includes:
- Your physical or electronic signature.
- Identification of the material that was removed and its location before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
- Your name, address, phone number, and a statement that you consent to the jurisdiction of the federal court in your district (or, if outside the US, an appropriate judicial district) and will accept service of process from the person who filed the original notice.
Our process
On receiving a valid notice, we'll review it, and where appropriate disable or revoke the relevant share link or paid-access listing and notify the account holder. Accounts with repeat, verified infringement will be terminated.
